Welcome to Key West Charter Fishing. By participating in our fishing charters, you agree to the terms outlined in this Waiver and Release of Liability (“Waiver”). Please read this document carefully before booking or participating in any of our fishing trips.
I, the undersigned participant, acknowledge that engaging in fishing activities involves inherent risks, including but not limited to:
I understand that these risks can result in serious injury, permanent disability, or death. I voluntarily assume all such risks associated with participating in fishing activities with Key West Charter Fishing.
In consideration of being permitted to participate in fishing activities provided by Key West Charter Fishing, I hereby release, waive, discharge, and covenant not to sue Key West Charter Fishing, its owners, directors, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any property belonging to me, whether caused by the negligence of Key West Charter Fishing or otherwise, while participating in such activities.
I agree to indemnify and hold harmless Key West Charter Fishing, its owners, directors, employees, agents, and affiliates from any loss, liability, damage, or cost, including reasonable attorneys’ fees, that they may incur due to my participation in fishing activities, whether caused by negligence or otherwise.
I agree to follow all safety instructions and guidelines provided by Key West Charter Fishing and its crew. I understand that failure to adhere to these instructions may result in my removal from the fishing trip without refund.
I confirm that I am physically fit and have no medical conditions that would prevent me from safely participating in fishing activities. I acknowledge that Key West Charter Fishing does not provide medical insurance or cover any medical expenses in the event of an injury or illness.
I am responsible for bringing and maintaining any personal fishing equipment I choose to use. Key West Charter Fishing is not liable for any loss, damage, or injury resulting from the use of personal equipment.
This Waiver shall be governed by and construed in accordance with the laws of the State of Florida, United States. Any disputes arising out of or related to this Waiver shall be subject to the exclusive jurisdiction of the courts located in Key West, FL.
If any provision of this Waiver is found to be unenforceable or invalid under any applicable law, such invalidity shall not render this Waiver unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.
I have read this Waiver and Release of Liability carefully and fully understand its contents. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this Waiver freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
