Booking Agreement

Effective Date: December 10, 2024

1. Introduction

This Booking Agreement (“Agreement”) is a legally binding contract between you (“Customer”) and Key West Charter Fishing (“Company”) regarding the booking of fishing charters and related services. By making a reservation with us, you agree to the terms outlined in this Agreement.

2. Booking Process

  • How to Book:
    • Reservations can be made through our website, via email at contact@flyfishkw.com, or by calling us at +1 (305) 767-9828.
  • Confirmation:
    • Once your booking is received and processed, a confirmation email with trip details, pricing, and payment instructions will be sent to the email address provided.
  • Information Required:
    • To finalize your booking, you must provide:
      • Full name
      • Contact information (phone number and email)
      • Number of participants
      • Preferred trip date and type of charter

3. Payment Terms

  • Deposit:
    • A non-refundable deposit of 25% is required at the time of booking to secure your reservation.
  • Final Payment:
    • The remaining balance must be paid in full no later than 7 days before the scheduled trip date.
  • Payment Methods:
    • We accept major credit cards, PayPal, and direct bank transfers.

4. Cancellation and Refund Policy

  • Customer Cancellations:
    • Full refund (minus deposit) if canceled at least 7 days before the trip.
    • 50% refund if canceled within 3–6 days of the trip.
    • No refund for cancellations made less than 3 days before the trip.
  • Company Cancellations:
    • In the event of severe weather, mechanical issues, or other unforeseen circumstances, the Company reserves the right to cancel or reschedule your trip. A full refund or alternative date will be provided.

5. Participant Requirements

  • Age Requirements:
  • Fitness to Participate:
    • Customers must be in good physical condition to participate in fishing activities. Any medical conditions must be disclosed at the time of booking.

6. Safety and Conduct

  • Safety Compliance:
    • All participants must adhere to the safety guidelines provided by the crew. Non-compliance may result in removal from the trip without a refund.
  • Code of Conduct:
    • Guests are expected to behave respectfully towards crew members and fellow participants. Offensive or disruptive behavior will not be tolerated.

7. Liability and Waivers

  • Assumption of Risk:
    • Customers acknowledge that fishing charters involve inherent risks, including physical injury and exposure to weather conditions.
  • Waiver of Liability:
    • By participating, you agree to release the Company from liability for any injuries, damages, or losses incurred during the trip, except in cases of gross negligence or intentional misconduct.

8. Environmental and Legal Compliance

  • Fishing Regulations:

    • All fishing activities are conducted in compliance with local, state, and federal laws. Guests are required to adhere to bag and size limits, closed seasons, and protected species rules.
  • Environmental Stewardship:

    • Guests must follow guidelines to minimize environmental impact, including proper waste disposal and handling of marine life.

9. Changes to Bookings

  • Rescheduling:

    • Requests to reschedule must be made at least 7 days before the trip date. Rescheduling is subject to availability and may incur additional fees.
  • Adjustments:

    • Changes to the number of participants or trip details must be communicated promptly. Additional charges may apply for increased group sizes or upgraded services.

10. Force Majeure

Key West Charter Fishing is not responsible for cancellations or disruptions caused by events outside our control, including but not limited to natural disasters, government restrictions, or unforeseen mechanical failures. In such cases, we will work with you to reschedule or provide a refund as outlined in our Cancellation and Refund Policy.

11. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Florida, United States. Any disputes shall be resolved exclusively in the courts of Key West, Florida.
